Your Divorce Options

Massachusetts has two types of divorce

  • Uncontested divorce (1A): If you file a 1A divorce, you and your spouse agree to all terms and submit a separation agreement to the court for approval. The uncontested process is cheaper, simpler and quicker but only works if the parties are able to cooperate and trust each other.
  • Contested divorce (1B): If you file a 1B divorce, you and your spouse do not agree to one or all of the issues. If the parties are unable to negotiate a settlement, the issues will be presented to the judge in a trial.
